State Seeks Canyon Ownership

Utah has added the “road” through Recapture Canyon in San Juan County to the official list of roads it wants the federal government to hand over to state ownership.

County Commissioner Phil Lyman and another public official were recently convicted of illegally riding their all-terrain vehicles through the canyon as a protest against its closure to mechanized vehicles.

The state is calling the rough trail a “historic thoroughfare.”

Western states have been petitioning the federal government for years to cede ownership to them of rights-of-way across public lands under a Civil War-era law.

The Southern Utah Wilderness Alliance is contesting the claim, pointing out that Recapture Canyon is not on a county-produced map of rights-of-way, was not on the original list submitted by Utah, and was not named in a lawsuit brought by the county in 2012 seeking ownership of roads.
